Welcome to Studio, a product by The SnapBar, LLC ("Snapbar"). Studio is a web-based platform that enables users to capture or upload images of themselves to create professional headshots. Studio may be provided to you either:

  • Through your employer: Your company has engaged Snapbar to provide Studio for employee use.
  • Individually: You are using Studio independently, not through an employer.

By accessing or using Studio, you agree to these Terms of Use ("Terms") and our Privacy Policy. If you do not agree with these Terms, please do not use Studio. If your use of Studio is pursuant to a separate customer agreement, the terms of that agreement govern your use of Studio.

1. Use of Personal Information

Your use of Studio may involve sharing personal information with us. Our handling of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Studio, you consent to the collection and use of your information as outlined in the Privacy Policy.

2. Data Protection and Privacy Rights

We respect your privacy and are committed to protecting your personal information.

  • Your Rights: Depending on your location and applicable laws, you may have certain rights regarding your personal information, such as:
    • Accessing and receiving a copy of your personal data.
    • Correcting or updating inaccurate or incomplete data.
    • Requesting the deletion of your personal data.

  • Exercising Your Rights:
    • If You Are Using Studio Through Your Employer: Please direct any requests to exercise your privacy rights to your company administrator. They are responsible for managing such requests and will coordinate with us if necessary.

  • Our Role:
    • For Employer-Provided Access: We act as a data processor on behalf of your employer, processing your personal information solely to provide and improve Studio's services as instructed by your company.
    • For Individual Users: We act as the data controller for your personal information and process it to provide and enhance Studio's services.
  • Data Usage: We process your personal data only for the purposes of operating Studio and do not sell your personal information to third parties.
  • International Data Transfers: If you are accessing Studio from outside the United States, please note that your information may be transferred to and processed in the United States or other locations where our servers are located, in accordance with applicable data protection laws.
  • Data Retention:
    • Employer-Provided Access: Your personal data is retained in line with your company's policies and instructions. Please contact your company administrator for details about data retention periods.
    • Individual Users: We retain your personal information only as long as necessary to fulfill the purposes for which it was collected or as required by law.
  • Security Measures: We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction.

3. License to Use Studio

We grant you a limited, non-exclusive, non-transferable license to access and use Studio solely for creating professional headshots, in accordance with these Terms.

4. User Content

When you capture or upload images ("User Content") to Studio:

  • Ownership: You retain ownership of your User Content. We do not claim any ownership rights over it.
  • Permissions:
    • Processing Your Content: You grant us the necessary rights to process your User Content solely to provide the services offered by Studio.
    • Sharing with Your Employer: If you are using Studio through your employer, you acknowledge that your User Content may be accessible to authorized personnel within your company.
  • Appropriate Content: You agree not to upload content that is inappropriate, offensive, illegal, or violates applicable policies. This includes, but is not limited to, images containing nudity, violence, or discriminatory material.
  • No Infringement: You represent and warrant that your User Content does not infringe upon the rights of any third party, including intellectual property rights and privacy rights.

5. Content Removal

If you wish to remove any User Content from Studio:

  • Employer-Provided Access: Please contact your company administrator, who can assist with the removal process.
  • Individual Users: You may contact us directly at [email protected] to request removal of your User Content.

6. Prohibited Uses

You agree not to use Studio to:

  • Upload content that is unlawful, harmful, or violates these Terms.
  • Harass, abuse, or harm other individuals or groups.
  • Interfere with or disrupt the operation of Studio or its servers.
  • Attempt to reverse-engineer, decompile, or extract the source code of Studio.
  • Use automated systems or software to access or use Studio without our permission.

7. Intellectual Property

  • Snapbar's Content: All materials provided by Snapbar, including software, text, graphics, and images ("Content"), are owned by us or our licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute this Content without our express written permission.
  • Trademarks: "Snapbar" and associated logos are trademarks of Snapbar. You are not permitted to use these trademarks without our prior written consent.

8. Service Reliability

We aim to keep Studio available and running smoothly. However, we cannot guarantee that the platform will always be free from interruptions, delays, or errors. You acknowledge that you are using Studio at your own discretion and risk.

9. Limitation of Liability

While we strive to provide a great service, we are not responsible for any losses or damages that may occur from your use of Studio. To the extent allowed by law, Snapbar is not liable for any issues arising from your use of the platform.

10. User Responsibility

You're responsible for how you use Studio. If your actions lead to any problems or legal issues, you agree to handle those without involving Snapbar, as much as the law allows.

11. Updates to Terms

We might update these Terms occasionally to make Studio better. We'll post any changes on this page. By continuing to use Studio after updates are posted, you agree to the new Terms. If you have a separate agreement with us, that agreement won't be changed by these updates.

12. Access and Use

We hope you enjoy using Studio. If you don't follow these Terms or engage in activities that harm Studio or other users, we might have to limit or stop your access to the platform. We'll try to let you know if that happens.

13. Applicable Laws

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in accordance with applicable laws.

14. If Part of These Terms Doesn't Apply

If a part of these Terms doesn't hold up legally, the rest of the Terms still apply.

15. Complete Agreement

These Terms and our Privacy Policy make up the whole agreement between you and Snapbar regarding Studio. If there's a conflict between these Terms and another agreement you have with us (such as a customer agreement with your employer), that other agreement takes priority.
